Justiça midiática digital na era das redes sociais e seus impactos nos direitos fundamentais

Abstract

O presente trabalho analisa o fenômeno da justiça midiática digital na era das redes sociais e seus impactos sobre os direitos fundamentais no ordenamento jurídico brasileiro. A pesquisa investiga como a espetacularização do crime e a formação de "tribunais da internet" comprometem garantias constitucionais basilares, como a presunção de inocência, o devido processo legal e o direito à honra. Por meio de uma abordagem qualitativa e do método dedutivo, realiza-se uma revisão bibliográfica e a análise de casos emblemáticos, como o Caso Escola Base, Neymar vs. Najila e Mariana Ferrer. O estudo aborda a evolução da responsabilidade das plataformas digitais, destacando a decisão do Supremo Tribunal Federal de 2025 sobre o Marco Civil da Internet e a edição da Lei Mariana Ferrer. Conclui-se que a mitigação dos efeitos da justiça midiática exige um equilíbrio entre a liberdade de expressão e a proteção da dignidade humana, demandando maior responsabilidade das plataformas, educação digital e a preservação da imparcialidade do Poder Judiciário frente ao clamor popular.

This study analyzes the phenomenon of digital media justice in the age of social networks and its impacts on fundamental rights within the Brazilian legal system. The research investigates how the spectacularization of crime and the formation of "internet tribunals" compromise core constitutional guarantees, such as the presumption of innocence, due process of law, and the right to honor. Using a qualitative approach and the deductive method, a bibliographic review and an analysis of emblematic cases, such as the Escola Base Case, Neymar vs. Najila, and Mariana Ferrer, are conducted. The study addresses the evolution of digital platform liability, highlighting the 2025 Brazilian Supreme Court decision on the Civil Framework for the Internet and the enactment of the Mariana Ferrer Law. It concludes that mitigating the effects of media justice requires a balance between freedom of expression and the protection of human dignity, demanding greater platform accountability, digital education, and the preservation of the Judiciary's impartiality in the face of public outcry.
