Responsabilidade penal do menor infrator

Abstract

A responsabilidade penal do menor infrator é um tema de grande relevância na atualidade, devido as notáveis alterações ocorridas na legislação brasileira nos últimos anos. Este trabalho tem o intuito de fornecer informações de forma clara e objetiva acerca desse assunto, realçando a crucialidade de discutir sobre a responsabilidade penal do menor infrator. A pesquisa aborda diversas questões, como a evolução histórica da responsabilidade penal, a imputabilidade e culpabilidade, incluindo as medidas socioeducativas estipuladas no Estatuto da Criança e do adolescente (ECA, 1990) e o impacto da aplicação dessas medidas sobre as crianças e adolescentes envolvidos. A compreensão da legislação atual e suas implicações assume um papel de extrema importância na busca por uma sociedade mais justa e segura para todos. Para realizar este trabalho, foram utilizadas pesquisas descritivas, sendo assim, o método bibliográfico, no qual levantaram-se informações necessárias a a partir de livros, artigos, teses e outros materiais. Assim sendo, concluímos que a abordagem deve ser equilibrada, buscando uma justiça que considere a proteção dos direitos do menor, mas também a responsabilização pelos atos cometidos e investir em programas de ressocialização e prevenção é crucial para evitar a reincidência e permitir a reintegração do jovem na sociedade. ABSTRACT The criminal liability of juvenile offenders is a highly relevant topic today, given the significant changes in Brazilian legislation over recent years. This study aims to provide clear, objective information on the subject, highlighting the importance of discussing juvenile criminal liability. The research addresses various issues, such as the historical evolution of criminal liability, the concepts of imputability and culpability, the socio-educational measures stipulated in the Statute of the Child and Adolescent (ECA, 1990), and the impact of these measures on the children and adolescents involved. Understanding current legislation and its implications plays a vital role in the pursuit of a fairer and safer society for all. This study employed descriptive research—specifically the bibliographic method—gathering necessary information from books, articles, theses, and other materials. We conclude that the approach must be balanced, seeking a form of justice that considers the protection of the minor's rights while also ensuring accountability for their actions; furthermore, investing in rehabilitation and prevention programs is crucial to preventing recidivism and facilitating the young person's reintegration into society.
