Redução da maioridade penal: o impacto da redução da maioridade penal no processo de socialização dos adolescentes infratores: estudo psicológico, social e familiar

Abstract

O presente trabalho tem como objetivo apresentar e analisar a problemática relacionada à redução da maioridade penal no Brasil, abordando as implicações dessa mudança legislativa para a sociedade. A proposta de redução da idade mínima em que um jovem pode ser responsabilizado criminalmente gera um intenso debate no país, sendo um tema que envolve aspectos jurídicos, sociais, familiares e psicológicos. A pesquisa busca explorar os impactos dessa alteração, tanto positivos quanto negativos, e apresenta discussões sobre as consequências dessa medida para o Sistema de Justiça Penal Juvenil, levando em consideração as especificidades do Código Penal Brasileiro e o Estatuto da Criança e do Adolescente (ECA). Foi desenvolvido a partir de uma revisão bibliográfica que incluiu livros, artigos científicos e pesquisas sobre a realidade dos jovens infratores, seus comportamentos e as possíveis repercussões psicológicas que a redução da maioridade penal pode ocasionar. Esse estudo se propôs a esclarecer se a redução da maioridade penal seria, de fato, uma solução eficaz para a criminalidade juvenil ou se, ao contrário, poderia gerar um agravamento dos problemas relacionados à violência e ao tratamento dos jovens no sistema penal. ABSTRACT This paper aims to present and analyze the issues related to lowering the age of criminal responsibility in Brazil, addressing the implications of this legislative change for society. The proposal to reduce the minimum age at which a young person can be held criminally responsible generates intense debate in the country, being a topic that involves legal, social, family, and psychological aspects. The research seeks to explore the impacts of this change, both positive and negative, and presents discussions on the consequences of this measure for the Juvenile Criminal Justice System, taking into account the specificities of the Brazilian Penal Code and the Statute of the Child and Adolescent (ECA). It was developed from a literature review that included books, scientific articles, and research on the reality of young offenders, their behaviors, and the possible psychological repercussions that reducing the age of criminal responsibility may cause. This study aimed to clarify whether reducing the age of criminal responsibility would, in fact, be an effective solution to juvenile crime or whether, on the contrary, it could lead to an aggravation of problems related to violence and the treatment of young people in the penal system.
