Prevenção e controle da poluição por oléo no terminal marítimo norte capixaba

Abstract

Incidentes de derramamento de óleo no mar em diferentes países do mundo motivaram a criação de sistemas de prevenção à poluição marinha. No Brasil, a Lei n. 9966/2000 é o principal instrumento regulamentador da matéria. Este artigo discute a aplicação, no período de 2005 a 2014, dos instrumentos de prevenção e controle da poluição por óleo previstos nesta Lei, em um terminal marítimo no Estado do Espírito Santo. Os instrumentos de investigação adotados foram a pesquisa bibliográfica e a pesquisa documental. Foram verificadas as medidas de controle e fiscalização realizadas pelo órgão ambiental competente; levantados os incidentes de vazamento de óleo no mar ocorridos no Terminal Norte Capixaba - TNC; e verificadas as medidas aplicadas pelo órgão ambiental e ações de prevenção e resposta adotadas pela empresa quando da ocorrência de incidentes de vazamento de óleo no mar. A pesquisa permitiu concluir que há um esforço do órgão ambiental pela aplicação dos instrumentos de prevenção dispostos na Lei, porém, o descumprimento de prazos por parte da empresa e a demora do órgão nas análises pode comprometer a eficácia da prevenção da poluição por óleo no mar.

Incidents of oil spills in the sea in different countries of the world motivated the creation of systems of prevention to the marine pollution. In Brazil, Law n. 9966/2000 is the main regulatory instrument in this area. This article presents the results of a study on the application, from 2005 to 2014, of oil pollution prevention and control instruments provided for in this Law, in a maritime terminal that moves oil in the State of Espírito Santo. The research instruments adopted were bibliographic research and documentary research. The control and inspection measures carried out by the competent environmental agency were verified; the incidents of oil leakage in the sea occurred at the Norte Capixaba Terminal; and verified the measures applied by the environmental agency and actions of prevention and response adopted by the company when the occurrence of incidents of oil leakage in the sea. The research allowed to conclude that there is an effort of the environmental agency for the application of the instruments of prevention established in the Law, however, noncompliance of deadlines by the company and the delay of the organ in the analyzes can compromise the effectiveness of the prevention of oil pollution in the sea
