LGPD: conceitos gerais e adequação

Abstract

Este trabalho tem como intuito mostrar de forma breve e suscinta sobre os conhecimentos gerais e adequação relacionadas à Lei Geral de Proteção de dados, a LGPD (Lei Geral de Proteção de Dados). Nele serão mostrados os principais tópicos segundo a lei, sobre o tema, formando um conhecimento geral sobre a lei, desde os seus fundamentos, quais são suas bases legais, quais são dos direitos do titular e os deveres do controlador. A pretensão será abordar tópicos sobre os envolvidos na lei, o titular, o controlador e o operador, qual o papel do DPO (data protector officer) e qual o papel do órgão regulador a ANPD (Agência Nacional de Proteção de Dados). Pretendemos também abordar sobre o objeto da lei que é o dado pessoal, descrevendo seus tipos e quais são suas importâncias, como deverá ser tratado, quais as etapas descritas na lei e como agir em caso de violação desses dados. Temos o intuito de descrever as sanções legais em caso de descumprimento da lei e quais serão os processos legais, quais as documentações e quais ferramentas serão utilizadas de acordo com suas necessidades. Na segunda etapa do trabalho, serão descritas as etapas da adequação, que tipo de documentação deve ser elaborada e as medidas para a proteção de dados e relatórios que deverão ser gerados para comprovações. Por último, pretende-se demostrar os modelos de documentos utilizados no processo de adequação, detalhando a utilidade de cada um e em qual momento deverão ser utilizados. Ao fim deste trabalho deverá ser demonstrado o conhecimento geral adquirido sobre a lei e sua adequação conforme o título do trabalho.

The intention of this research is to give a brief idea about The General Personal Data Protection Law, known as LGPD Law. It will cover the main topics on the subject, forming a general knowledge of the law. It will explain the law’s foundations, what are the legal bases, what are the rights of the holder and the duties of the controller. It will describe those involved in the law, the holder, the controller, and the operator. What is the role of the DPO and what is the role of the regulatory agency the ANPD? It will also explain about the object of the law that is personal data, describing its types and what its importance is. How it should be treated, what steps are described in the law and how to act in case of violation of this data. Legal sanctions in case of non-compliance with the law and what the legal processes will be described as well. Which documentation and tools will be used according to your needs? The second stage of the research will describe the stages of adequacy, what type of documentation must be prepared and measures for data protection and reports must be generated for evidence. Finally, the document templates used in the adaptation process will be demonstrated, detailing the usefulness of each one and when it should be used. At the end of this research, general knowledge about the law and its suitability according to the title of the research should be acquired.
