Análise da tecnologia NFT no direito autoral de mídias digitais

Abstract

O presente trabalho tem como objetivo contextualizar o estado atual da tecnologia de Non-Fungible Tokens e expor o funcionamento do Blockchain por trás dela, bem como analisar seus impactos atuais e suas potenciais aplicações futuras, utilizando o contexto de direitos autorais como um ponto focal. A pesquisa foi baseada em artigos acadêmicos e especializados, descrevendo a tecnologia de Blockchain e os NFTs, além de notícias sobre os impactos gerados por esses novos recursos, novamente, com um olhar voltado à direitos de propriedade e direitos autorais. Também, foi feita uma coleta de dados diretamente da rede de Blockchain Ethereum utilizando a ferramenta Etherscan, com o objetivo de descrever e exemplificar o armazenamento de dados nessa rede. Por meio desse estudo foi possível compilar algumas das principais mudanças e impactos que os Non-Fungible Tokens trouxeram e continuarão a trazer em um futuro próximo.

This research, aims to contextualize the current state of the Non-Fungible Token technology and to examine the functioning of the Blockchain behind it, as well as to analyze the current impacts and potential future applications, using the context of copyright laws as a prime focus. The research was based on academic and specialized articles, describing the Blockchain technology and the NFTs, in addition to news reports about the impacts provided by those new resources, again, aimed primarily at copyright laws. On top of that, a data extraction was made directly from the Ethereum Blockchain, using the tool Etherscan, with the goal of describing how the storage of data works on that network. Through this study it was possible to compile some of the main changes and influences that the Non-Fungible Tokens already brought and will keep bringing in the near future.
