Abstract

O presente trabalho pretende abordar as significativas mudanças que ocorreram na CLT com a promulgação da lei 13.467/2017. O trabalho aborda as mudanças ocorridas na CLT, desde que a Reforma Trabalhista foi sancionada, abordando a verdadeira razão por trás de tantas flexibilizações e retirada de direitos abordando desde os acordos trabalhistas, as mudanças nos processos de rescisão contratual, a homologação dispensada, às mudanças nos prazos de pagamentos de verbas rescisórias e a inclusão da nova modalidade de rescisão por comum acordo, a rescisão indireta, as demissões com e sem justa causa. Comentaremos as admissões e seus diferentes tipos, detalharemos o que é e a importância do CAGED, a modernização trabalhista e a inclusão do teletrabalho na CLT. Abordando também as mudanças ocorridas nos períodos de concessão das férias, aquisição, o início das férias, o fracionamento, as férias individuais e coletivas. Comentaremos sobre as flexibilizações nos diversos tipos de jornadas de trabalho, as mudanças na jornada parcial, a inclusão da jornada 12x36 na CLT e etc. Ademais, iremos revisitar a história dos sindicatos e a importância que eles têm na vida dos trabalhadores e as alterações feitas na CLT com relação a contribuição sindical.

This paper aims to address the significant changes that occurred in the CLT with the enactment of law 13.467/2017. The work addresses the changes in the CLT, since the Labor Reform was sanctioned, addressing the real reason behind so many flexibilities and withdrawal of rights addressing from labor agreements, changes in the processes of contract termination, the dismissed homologation, the changes in the deadlines for payment of severance pay and the inclusion of the new method of termination by mutual agreement, indirect termination, layoffs with and without cause. We will comment on admissions and their different types, detail what CAGED is and its importance, labor modernization, and the inclusion of telework in CLT. We will also address the changes that have occurred in the periods for granting vacation, acquisition, the beginning of vacation, fractioning, individual and collective vacation. We will comment on the flexibilization of the various types of working hours, the changes in the part-time workday, the inclusion of the 12x36 workday in the CLT, etc. Furthermore, we will revisit the history of unions and the importance they have in the lives of workers and the changes made in the CLT regarding union contribution.
