Guarda compartilhada

Abstract

Este trabalho de conclusão de curso tem como objetivo apresentar o conceito, a evolução histórica, a previsão legal, a doutrina e a jurisprudência relacionadas ao instituto da guarda compartilhada, a que ela veio e como vem sendo aplicada no Brasil, ressaltando-se a importância dela no âmbito jurídico, incluindo o avanço que trouxe à sociedade. Buscar-se-á apresentar os tipos de guarda existentes e suas definições. Ademais, o presente artigo pretende conscientizar que esse tipo de guarda é um bom caminho a seguir e incentivar a sua prática no meio jurídico, pois ela se coaduna com a evolução das famílias e com uma sociedade que pensa e age de maneira cada vez mais diversa e independente. ABSTRACT This study aims to present the concept, historical evolution, legal framework, legal doctrine, and case law regarding the legal concept of shared custody—its purpose and its application in Brazil—while highlighting its importance within the legal sphere and the advancements it has brought to society. It seeks to outline the existing types of custody and their definitions. Furthermore, this article aims to raise awareness that shared custody is a beneficial approach and to encourage its practice within the legal community, as it aligns with the evolution of family structures and a society that thinks and acts in increasingly diverse and independent ways.
