Elementos fundamentais para o estudo do direito romano

Abstract

Este trabalho trata dos conceitos básicos jurídicos e históricos para a mínima compreensão de um jurista ao tema: direito romano. Fundamental e base para o direito no mundo inteiro, inclusive o brasileiro atual, o direito romano abrange uma série de normas vigentes em Roma por doze séculos que deixam clara a incrível evolução que se deu a ciência jurídica por meio de juristas de muitas e muitas gerações. De forma objetiva e clara, o trabalho alcança a matriz do nosso ordenamento jurídico e o mínimo para se estudar e compreender o direito. Transita por todos os períodos históricos trazendo uma análise social e polícia, além de jurídica, sendo muito importante para o entendimento e compreensão dos períodos históricos e das leis que vigoraram neles, não sendo possível entender a lei sem entender a sociedade. Transita também pelos institutos jurídicos e por assuntos de direito privado, principalmente, que vem tendo sua evolução até os dias de hoje com a base romana, como: família, sucessões, direitos do cidadão, capacidade, etc. Todos esses temas colocados compactamente e primordialmente com o necessário.

This schoolwork deals with the basic legal and historical concepts for a minimum understanding of a subject matter: Roman law. Roman law encompasses a series of norms in force in Rome for twelve centuries that make clear the incredible evolution of a juridical science through jurists of many and many generations. In an objective and clear way, the work is the best way to study and comprehend. Travels through all the historical periods bringing social and politic analysis, besides being legal, being very important for the understanding of the historical periods and of the laws that were in them, being not possible to understand to right without meaning of the society . It also travels through legal institutes and by private law post, mainly, which has been evolving to the present day with a Roman base, such as: family, inheritance, citizens' rights, capacity, etc. All of these themes compactly and primarily with the necessary.
