Mulheres no cárcere: as falhas do sistema prisional brasileiro

Abstract

O presente trabalho de conclusão de curso analisa as condições de vida da mulher nas penitenciárias femininas brasileiras e a efetivação dos direitos e garantias individuais das prisioneiras em face da lei penal e da lei n° 7.210/1984, Lei de Execução Penal. O objetivo dessa pesquisa é, por meio de um estudo interdisciplinar, verificar a eficácia da execução das penas privativas de liberdade atualmente, apresentando razões para justificar o porquê de o sistema penitenciário feminino não atingir o objetivo da ressocialização após o cumprimento de pena. É buscado assim, promover uma deliberação sobre a grande cobrança feita por parte da sociedade para agravar as penas e prender cada vez mais pensando em aumentar a segurança. Porém o que não é levado em conta é a reforma necessária no sistema penitenciário, que possui uma elevada superlotação e falta de estrutura que dificultam o cumprimento do que ele tem designado. A metodologia utilizada foi o estudo de livros, matérias jornalísticas, documentos, análises estatísticas, legais e normativas.

The present course conclusion paper analyzes the living conditions of women in Brazilian female prisons and the realization of the rights and individual guarantees of prisoners in the light of criminal law and Law Number 7.210/1984, Penal Execution Law. The objective of this research is, through an interdisciplinary study, to verify the effectiveness of the execution of the custodial sentences currently, presenting reasons to justify why the female penitentiary system does not reach the goal of resocialization after the sentence. Its purpose is to promote a deliberation on the great charge made by society to increase the penalties and arrest increasingly thinking about increasing security. But what is not considered is the necessary reform in the penitentiary system, which has a high overcrowding and lack of structure that make it difficult to fulfill what it has designated. The methodology used was the study of books, journalistic articles, documents, besides the statistical, legal and normative analyzes.
