A compreensão da adoção unilateral e uma breve discussão da adoção por homossexuais dentro deste paradigma

Abstract

O presente artigo visa apresentar um breve conceito a adoção unilateral no Brasil, incluindo seus requisitos, e também faz uma análise ao vínculo afetivo e ainda o procedimento homoafetivo, proporcionando as legislações legais e sociais, bem como introduzidas na lei n.° 8.069/90, no Estatuto da Criança e do Adolescente. Inicialmente, o conteúdo da pesquisa será estudado a importância e o reconhecimento afetivo como o valor jurídico. É importante salientar que a adoção unilateral é o registro do filho de outrem como se fosse seu próprio filho, possuindo os mesmos direitos de um filho biológico. Há o enfoque do ambiente familiar concedido a esses menores, uma conjetura de um estado de convivência. Sendo o Estatuto da Criança e do Adolescente e a Constituição Federal o real amparo respectivo a proteção e o bem-estar da criança e do adolescente. Em tese, considere a complexidade do processo e a importância de avaliar cada situação para garantir o melhor interesse da criança. A regulamentação utilizada foi o método documental e de questionários, com o objetivo de demonstrar o recurso jurídico do tema desenvolvido.

This article aims to present a brief concept of unilateral adoption in Brazil, including its requirements, and also analyzes the affective bond and the homoaffective procedure, providing legal and social legislation, as well as introduced in Law No. 8,069/90, the Statute of the Child and Adolescent. Initially, the content of the research will study the importance and recognition of affection as a legal value. It is important to note that unilateral adoption is the registration of someone else's child as if they were your own, with the same rights as a biological child. There is a focus on the family environment granted to these minors, a conjecture of a state of coexistence. The Statute of the Child and Adolescent and the Federal Constitution provide real support for the protection and well-being of children and adolescents. In theory, consider the complexity of the process and the importance of assessing each situation to ensure the best interests of the child. The regulation used was the documentary method and questionnaires, with the aim of demonstrating the legal resource of the theme developed.
