Guarda compartilhada: a difícil passagem da teoria à prática

Abstract

A guarda compartilhada surgiu na Inglaterra no ano de 1960, a mesma foi criada com o intuito de visar o bem-estar do menor e para que seus interesses fossem colocados em primeiro lugar, com isso o mesmo sofreria menos com a separação dos pais. Há vantagens na guarda compartilhada, como a participação mais ativa de ambos os genitores na vida do filho. Porém, há desvantagens, como a desarmonia entre os pais separados, não favorecendo essa modalidade de guarda. Tendo em vista que a mesma deixou de ser utilizada como exceção e passou a ser aplicada como regra. ABSTRACT Joint custody originated in England in 1960, created with the aim of prioritizing the well-being of the child and ensuring their interests are put first, thus minimizing the impact of parental separation. There are advantages to joint custody, such as more active participation from both parents in their child's life. However, there are disadvantages, such as the potential for disharmony between separated parents, which is not favorable for this type of custody. This is because it has ceased to be used as an exception and has become the rule.
