Crimes contra a honra: calúnia, injúria e difamação

Abstract

Crime é ato infracional que viola as leis e as garantias individuais. Os crimes contra a honra são aqueles que ferem a dignidade da pessoa humana e estão previstos no Código de Processo Penal, que os divide em calúnia, difamação, e injúria, possuindo, cada um, uma definição e penalidade distinta. Ter ciência sobre a definição destes crimes é imprescindível, pois desde quando existe a honra, existe a ofensa. Há séculos as pessoas são prejudicadas com acusações falsas, com boatos depreciativos e com ofensas diretas. Mas a verdade é que, muitas vezes, os crimes contra a honra se tornam algo muito mais grave do que uma fofoca ou um xingamento, eles seguem "um complexo de bola de neve", vão se enrolando até se tornar algo inimaginável adverso, podendo resultar até mesmo em morte. Logo, tomando nota de que estes crimes sempre se fizeram presentes na história e que podem resultar em consequências funestas, vê-se que é de extrema importância que a população tenha conhecimento sobre a definição exata de calúnia, difamação e injúria, que saibam que estes crimes são tão danosos quanto qualquer outro e que podem recorrer à justiça em busca de seus direitos e garantias, preservando a honra e a dignidade humana. è importante denunciar qualquer ato infracional que fira a honra e a dignidade de alguém, este é o primeiro passo de uma longa caminhada na luta contra o desrespeito e as violências emocionais e psicológicas que infelizmente são tão comuns na nossa sociedade. Este trabalho veio com o intuito de esclarecer dúvidas pertinentes na sociedade. ABSTRACT Crime is an act that violates laws and individual guarantees. Crimes against honor are those that harm the dignity of the human person and are stipulated in the Code of Criminal Procedure, which divides them into slander, defamation, and insult, each with a distinct definition and penalty. Understanding the definition of these crimes is essential, because offense exists as long as honor exists. For centuries, people have been harmed by false accusations, derogatory rumors, and direct insults. But the truth is that, often, crimes against honor become something much more serious than gossip or insults; they follow a "snowball effect," escalating until they become something unimaginably adverse, potentially even resulting in death. Therefore, noting that these crimes have always been present throughout history and can result in dire consequences, it is extremely important that the population understands the exact definition of slander, defamation, and libel, that they know these crimes are as damaging as any other, and that they can seek justice to protect their rights and guarantees, preserving honor and human dignity. It is important to report any infraction that harms someone's honor and dignity; this is the first step in a long journey in the fight against disrespect and emotional and psychological violence that are unfortunately so common in our society. This work aims to clarify pertinent doubts in society.
