Dos crimes contra a vida: feminicídio

Abstract

Este presente trabalho teve como objetivo informar sobre anova lei qualificadora de homicídio denominada feminicídio, onde prega a violência contra mulher por razões de gênero, a metodologia usada teve como base artigos de leis, doutrinas, documentos eletrônicos, dados estatísticos, entre outros. Foram realizadas pesquisas sobre o percentual de violência contra mulher no Brasil e no mundo. Decorre sobre os crimes dolosos contra a vida, a vida como um bem jurídico, o conceito de crime, os tipos de feminicídio além de demonstrar a concepção de inferioridade feminina desde os primórdios dos séculos, sem esquecer o ponto mais polêmico do trabalho, no qual toca na "suposta inconstitucionalidade" da lei em relação ao artigo 5º da Constituição Federal de 1988. Os crimes dolosos contra a vida, como já citado acima na qualificação de feminicídio são julgados pelo tribunal do Júri, outro tópico que será tratado nesse presente trabalho. ABSTRACT This work aimed to inform about the new law qualifying homicide as femicide, which addresses violence against women for reasons of gender. The methodology used was based on legal articles, doctrines, electronic documents, statistical data, among others. Research was conducted on the percentage of violence against women in Brazil and worldwide. It discusses intentional crimes against life, life as a legal good, the concept of crime, the types of femicide, and demonstrates the conception of female inferiority since the beginning of time, without forgetting the most controversial point of the work, which touches on the "alleged unconstitutionality" of the law in relation to Article 5 of the 1988 Federal Constitution. Intentional crimes against life, as already mentioned above in the qualification of femicide, are judged by the jury court, another topic that will be addressed in this work.
