Eutanásia: uma morte digna e o direito à vida

Abstract

O trabalho tem como objetivo principal analisar a eutanásia sob os aspectos jurídicos, éticos, médicos e sociais, discutindo sua relação com o direito à vida e a dignidade da pessoa humana. A ideia central parte da importância de respeitar a autonomia do paciente para decidir sobre o fim da própria vida em situações de sofrimento irreversível ou doenças terminais. A partir disso, busca-se abrir um debate sobre a necessidade de atualizar a legislação brasileira para acompanhar as demandas atuais por uma morte mais digna e humanizada. Nesse contexto, o estudo também incorpora objetivos específicos voltados a examinar comparativamente a legislação brasileira e a de outros países, analisar os princípios constitucionais relacionados à proteção da vida e à autonomia do paciente, investigar os aspectos bioéticos que envolvem a dignidade humana, avaliar o papel dos profissionais da saúde nos cuidados paliativos e discutir as implicações sociais e culturais do tema. De forma complementar, o trabalho visa contribuir para o meio acadêmico ao refletir sobre como as políticas públicas podem evoluir para equilibrar a proteção da vida com o respeito à autonomia individual na escolha de uma morte digna. O trabalho também aborda os conflitos entre cultura, religião e ética, destacando que a religião é uma das principais barreiras à legalização da eutanásia em países de tradição cristã, como o Brasil. A discussão deve, portanto, buscar equilíbrio entre os valores morais e o respeito à autonomia pessoal. São analisados os aspectos jurídicos penais da eutanásia e o anteprojeto do novo Código Penal, que propõe a despenalização parcial da prática em casos de compaixão e sofrimento extremo. A metodologia adotada inclui pesquisa bibliográfica baseada em artigos, sites e outras fontes confiáveis, além da aplicação de um formulário destinado a compreender diferentes percepções sociais sobre o tema. A análise de dados, composta por uma pesquisa quantitativa com 19 participantes de diferentes idades, incluindo pessoas da área jurídica e da área da saúde, revelou que 95% conhecem o tema e 63% são favoráveis à legalização da eutanásia no Brasil. Conclui-se que a eutanásia, quando pautada pela compaixão e pela autonomia individual, representa uma forma de preservar a dignidade humana diante do sofrimento irreversível, reforçando a importância de discutir sua possível implementação no Brasil ABSTRACT The main objective of this work is to analyze euthanasia from legal, ethical, medical, and social perspectives, discussing its relationship with the right to life and the dignity of the human person. The central idea stems from the importance of respecting the patient's autonomy to decide on the end of their own life in situations of irreversible suffering or terminal illness. From this, it seeks to open a debate on the need to update Brazilian legislation to meet current demands for a more dignified and humane death. In this context, the study also incorporates specific objectives aimed at comparatively examining Brazilian legislation with that of other countries, analyzing the constitutional principles related to the protection of life and patient autonomy, investigating the bioethical aspects involving human dignity, evaluating the role of healthcare professionals in palliative care, and discussing the social and cultural implications of the topic. Complementarily, the work aims to contribute to the academic community by reflecting on how public policies can evolve to balance the protection of life with respect for individual autonomy in choosing a dignified death. This work also addresses the conflicts between culture, religion, and ethics, highlighting that religion is one of the main barriers to the legalization of euthanasia in countries with a Christian tradition, such as Brazil. The discussion should, therefore, seek a balance between moral values ​​and respect for personal autonomy. The legal and penal aspects of euthanasia and the draft of the new Penal Code, which proposes the partial decriminalization of the practice in cases of compassion and extreme suffering, are analyzed. The methodology adopted includes bibliographic research based on articles, websites, and other reliable sources, in addition to the application of a questionnaire designed to understand different social perceptions on the subject. The data analysis, consisting of a quantitative survey with 19 participants of different ages, including people from the legal and health fields, revealed that 95% are familiar with the topic and 63% are in favor of the legalization of euthanasia in Brazil.It is concluded that euthanasia, when guided by compassion and individual autonomy, represents a way to preserve human dignity in the face of irreversible suffering, reinforcing the importance of discussing its possible implementation in Brazil.
