A normalização da violência sexual no âmbito conjugal

Abstract

O presente trabalho tem como temática a violência sexual e psicológica que muitas mulheres enfrentam dentro do casamento, conhecida como estupro marital. Infelizmente, esse crime ainda é encarado com naturalidade por muitas pessoas. O estupro marital ocorre quando a mulher é forçada a ter relações sexuais sem seu consentimento dentro do casamento — algo que, muitas vezes, não é reconhecido pela sociedade. Isso acontece porque ainda existe uma forte crença de que a mulher tem a obrigação de satisfazer o marido. Para compreender o estupro conjugal, é fundamental analisá-lo de forma interdisciplinar, levando em conta sua história, os aspectos jurídicos, sociais e psicológicos envolvidos. Essa naturalização da violência revela o pouco conhecimento sobre os direitos das mulheres, o que mantém o ciclo de abuso e silêncio. Por isso, é essencial que o Estado divulgue informações claras e crie políticas públicas que incentivem a denúncia, oferecendo apoio psicológico e jurídico às vítimas, para ajudá-las a romper com essa violência. Dessa forma, objetivo deste trabalho é analisar o estupro conjugal sob os aspectos históricos, legais e sociais, ressaltando a importância de proteger os direitos das vítimas e avaliar a eficácia das leis existentes. Os objetivos específicos deste trabalho incluem abordar o ponto de vista jurídico sobre o tema, analisando até onde existe consentimento no ato e apresentando a ocorrência do abuso psicológico dentro do relacionamento. Busca-se compreender por que o estupro conjugal é frequentemente normalizado, identificar suas consequências psicológicas e explanar sobre os principais desafios da legislação atual para caracterizar e punir esse crime. Além disso, pretende-se entender os obstáculos que impedem as mulheres de denunciar, informar sobre como o estupro conjugal é tratado fora do Brasil, estudar o papel da sociedade, da mídia e da educação na mudança da percepção pública e cultural sobre o tema, e discorrer sobre a evolução histórica do estupro marital. Para isso, realizou-se uma pesquisa bibliográfica e de campo, buscando aprofundar o tema e estimular uma reflexão crítica que contribua para desconstruir mitos e fortalecer o combate a essa grave violação. A pesquisa evidenciou que, embora o estupro conjugal tenha sido historicamente invisibilizado e por muito tempo legitimado por normas sociais e jurídicas ultrapassadas, avanços importantes foram alcançados graças ao fortalecimento dos movimentos feministas, às mudanças legislativas e ao crescente debate público sobre o tema.Constatou-se que hoje há maior reconhecimento de que a violência sexual pode ocorrer dentro do casamento, ampliando a proteção jurídica às vítimas e incentivando políticas públicas voltadas à conscientização, ao acolhimento e ao enfrentamento da violência de gênero. Ainda que persistam desafios culturais, sociais e institucionais, os resultados demonstram progresso significativo na desconstrução da ideia de “direito conjugal absoluto”, no reconhecimento da autonomia corporal da mulher e na promoção de uma cultura baseada no consentimento, no respeito e nos direitos humanos. ABSTRACT This work addresses the sexual and psychological violence that many women face within marriage, known as marital rape. Unfortunately, this crime is still viewed as normal by many people. Marital rape occurs when a woman is forced to have sexual relations without her consent within marriage—something that is often not recognized by society. This happens because there is still a strong belief that a woman has an obligation to satisfy her husband. To understand marital rape, it is essential to analyze it in an interdisciplinary way, taking into account its history, and the legal, social, and psychological aspects involved. This normalization of violence reveals a lack of knowledge about women's rights, which maintains the cycle of abuse and silence. Therefore, it is essential that the State disseminates clear information and creates public policies that encourage reporting, offering psychological and legal support to victims to help them break free from this violence. Therefore, the objective of this work is to analyze marital rape from historical, legal, and social perspectives, highlighting the importance of protecting victims' rights and evaluating the effectiveness of existing laws. The specific objectives of this work include addressing the legal perspective on the topic, analyzing the extent to which consent exists in the act and presenting the occurrence of psychological abuse within the relationship. It seeks to understand why marital rape is frequently normalized, identify its psychological consequences, and explain the main challenges of current legislation in characterizing and punishing this crime. Furthermore, it aims to understand the obstacles that prevent women from reporting, inform about how marital rape is treated outside of Brazil, study the role of society, the media, and education in changing public and cultural perceptions on the subject, and discuss the historical evolution of marital rape. To this end, bibliographic and field research was conducted, seeking to deepen the understanding of the topic and stimulate critical reflection that contributes to deconstructing myths and strengthening the fight against this serious violation. The research showed that, although marital rape has been historically invisible and for a long time legitimized by outdated social and legal norms, important advances have been achieved thanks to the strengthening of feminist movements, legislative changes, and the growing public debate on the subject. It was found that today there is greater recognition that sexual violence can occur within marriage, expanding legal protection for victims and encouraging public policies aimed at raising awareness, providing support, and confronting gender-based violence. Although cultural, social, and institutional challenges persist, the results demonstrate significant progress in deconstructing the idea of ​​"absolute marital rights," in recognizing women's bodily autonomy, and in promoting a culture based on consent, respect, and human rights.
