A falta de acesso à justiça para vítimas de violência obstétrica.

Abstract

O presente estudo aborda a problemática da falta de acesso à justiça para as vítimas de violência obstétrica, um obstáculo global que envolve práticas abusivas, desrespeitosas ou negligentes durante todo o processo do parto, podendo resultar em danos físicos, psicológicos e emocionais para as mulheres e seus bebês. Dessa forma, a violência obstétrica se caracteriza de diversas formas, como agressões físicas, discriminação de gênero, e abusos relacionados a questões de raça, classe social, entre outros. Nesse sentido, no Brasil, dados de 2010 indicam que uma em cada quatro mulheres sofre algum tipo de violência obstétrica, o que deixa evidente a gravidade da questão, e muitas vítimas enfrentam dificuldades ao procurar a justiça, devido à falta de informações, medo de represálias, desigualdades de recursos e falhas nos sistemas jurídicos e de saúde. Desse modo, a falta de uma legislação específica e políticas públicas adequadas agrava ainda mais esse cenário, dificultando a responsabilização dos profissionais e instituições responsáveis. Contudo, a pesquisa destaca a importância de criar um ambiente seguro e respeitoso durante o parto, com foco na segurança física e emocional das mulheres e dos bebês, além de garantir o consentimento informado e a permanência do processo de cuidado. Além disso, a escassez legislativa e a falta de mecanismos eficazes para combater a violência obstétrica exigem atenção urgente para a proteção dos direitos das mulheres e a construção de um sistema de saúde mais justo e eficiente, em que prevaleça as práticas respeitosas, a humanização no pré-natal, parto e pós-parto e os direitos relacionados a saúde, segurança e a vida.

This study addresses the issue of lack of access to justice for victims of obstetric violence, a global obstacle that involves abusive, disrespectful or negligent practices throughout the birth process, which can result in physical, psychological and emotional harm to women and your babies. Thus, obstetric violence is characterized in different ways, such as physical aggression, gender discrimination, and abuse related to issues of race, social class, among others. In this sense, in Brazil, data from 2010 indicate that one in four women suffers some type of obstetric violence, which makes the seriousness of the issue evident, and many victims face difficulties when seeking justice, due to lack of information, fear of reprisals, inequalities in resources and failures in the legal and health systems. Therefore, the lack of specific legislation and appropriate public policies further aggravates this scenario, making it difficult to hold responsible professionals and institutions accountable. However, the research highlights the importance of creating a safe and respectful environment during birth, focusing on the physical and emotional safety of women and babies, as well as ensuring informed consent and the continuity of the care process. Furthermore, the legislative scarcity and the lack of effective mechanisms to combat obstetric violence require urgent attention to the protection of women's rights and the construction of a fairer and more efficient health system, in which respectful practices prevail, humanization in prenatal, childbirth and postpartum and rights related to health, safety and life.
