Reflexos jurídicos da homofobia: entre demandas de criminalização e educação.

Abstract

O problema central deste trabalho refere-se a melhor maneira para combater a homofobia, discutindo-se se esse objetivo poderia ser atingido através da educação ou da criminalização. A relevância do tema se deve ao não reconhecimento de direitos dos indivíduos LGBTQ+, que acaba por reforçar a discriminação que eles sofrem. Como não há uma diretriz clara a respeito da inclusão do tópico na educação básica nem mesmo uma lei que os proteja criminalmente, verifica-se a vulnerabilidade dessa população. Para resolução do problema proposto, foram realizadas pesquisas bibliográficas, documentais e empíricas (pesquisa de campo). Feitas no decorrer deste trabalho, dão indícios de que a melhor maneira para combater este problema seria através da educação, pois crianças e adolescentes passam a maior parte do seu tempo em escolas, tendo a educação como um alvo importante para as lutas sociais.

The central problem of this work is the best way to combat homophobia, arguing whether this goal could be achieved through education or criminalization. The relevance of the theme is due to the non-recognition of rights of LGBTQ + individuals, which ultimately reinforce the discrimination they suffer. As there is no clear guideline regarding the inclusion of the topic in basic education nor even a law that protects them criminally, it is verified the vulnerability of this population. To solve the problem proposed, bibliographical, documentary and empirical research (field research) was carried out. Made in the course of this work, give indications that the best way to combat this problem would be through Education, as children and adolescents spend most of their time in schools, with education as an important target for social struggles.
