Delação premiada: aspectos positivos e negativos.

Abstract

A delação premiada é um termo empregado na esfera jurídica e atua como uma espécie de “troca de favores” entre o juiz e o réu. No qual o acusado provê informações referente á organizações criminosas prestando auxílio no solucionar dos crimes, obtendo como compensação, sua pena reduzida no momento que for julgado. O presente trabalho tem por objetivo através das informações legais conscientizar a população sobre o uso de tal instituto, qual a sua finalidade e benefícios que o delator pode conceder, bem como verificar a possibilidade da criação de um projeto de lei em que se padronize o tratamento entre o denunciador e os demais coautores e partícipes, regulando as penalidades aplicadas e instituindo com que o delator cumpra a pena em regime fechado. Foram realizadas pesquisas bibliográficas, com a interpretação de obras, artigos acadêmicos e a legislação brasileira. Ademais, foi produzida pesquisa quantitativa, em forma de entrevista com o Juiz de Direito da Comarca de Estrela D’Oeste Dr. Mateus Lucatto Campos e realizou-se pesquisa de campo com 200 (duzentas) pessoas diferentes, referente à pesquisa qualitativa. Por meio da pesquisa de campo realizada, podemos analisar que o instituto da delação premiada apesar de auxiliar a desvendar muitos crimes, não é aprovado pela população, porém o magistrado acredita que a delação premiada é um avanço no sistema judiciário brasileiro. Conclui-se que apesar de muitos comentários negativos ao uso de tal instituto, que este dispõe de um amplo auxílio quanto ao combate do crime organizado.

The prize award is a term used in the legal sphere and acts as a kind of "exchange of favors" between the judge and the defendant. In which the accused provides information regarding criminal organizations assisting in resolving crimes, obtaining as compensation, his reduced sentence at the time he is tried. The objective of this study is to make the public aware of the use of such an institute, its purpose and benefits that the informant can grant, as well as verifying the possibility of creating a bill that standardizes the treatment between the denouncer and the other coauthors and participants, regulating the penalties applied and instituting with that the delator fulfills the sentence in a closed regime. Bibliographical research was carried out, with the interpretation of works, academic articles and Brazilian legislation. In addition, a quantitative research was conducted in the form of an interview with the Judge of the District of Estrela D'Oeste, Dr. Mateus Lucatto Campos, and field research was conducted with 200 (two hundred) different people, referring to qualitative research. Through the field research carried out, we can analyze that the institute of the awarding of the award despite helping to unravel many crimes, is not approved by the population, but the magistrate believes that the awarding of the award is an advance in the Brazilian judicial system. It is concluded that despite many negative comments to the use of such an institute, that it has an ample aid in the fight against organized crime.
