A legislação trabalhista brasileira: home office

Abstract

Conhecer as leis vigentes é de extrema importância. São elas que revelam quais os direitos e deveres que possuímos como cidadãos integrantes de um Estado Democrático. Com esse fato em compreensão, o foco deste artigo é investigar se a atual legislação trabalhista brasileira corrobora em prol do trabalho remoto. Igualmente, será ressaltado neste trabalho os benefícios e os impactos dos quais uma legislação integralmente funcional se apresenta. Busca-se ilustrar a clássica relação de emprego que tende a se transmutar para uma relação com maior flexibilidade no trabalho, conjuntamente das leis trabalhistas brasileiras. Para isso, apresenta-se as mudanças na reforma trabalhista que são realmente válidas para o tele trabalho e a motivação de sua promulgação, para, em seguida, avaliar os possíveis impactos das mesmas, procurando chamar a atenção para seus pontos contraditórios, em especial ao tele trabalho.

It is extremely important to know the laws in effect. They are the ones that reveal the rights and duties that we have as citizens of a Democratic State. With this fact in mind, the focus of this article is to investigate whether the current Brazilian labor legislation supports remote work. Likewise, it will be highlighted in this paper the benefits and impacts of which a fully functional legislation presents itself. The aim is to illustrate the classic employment relationship that tends to transmute itself into a relationship with greater flexibility at work, jointly of the Brazilian labor laws. To this end, the changes in the labor reform that are actually valid for telework and the motivation for its enactment are presented, and then the possible impacts of these changes are evaluated, seeking to draw attention to their contradictory points, especially regarding telework.
