Abertura e regulamentação de microempresa, sociedade limitada com tributação no simples nacional em São José do Rio Preto/SP.

Abstract

O presente artigo descreve o processo de abertura e regulamentação de microempresa, de natureza jurídica, sociedade limitada com tributação no Simples Nacional em São José do Rio Preto/SP, etapas estas descritas nas esferas de âmbito municipal, estadual e federal. Com o objetivo de demonstrar de forma sintetizadas tais etapas de abertura no município em questão, a importância do profissional contábil durante este processo e os benefícios financeiros, judiciais entre tantos outros adquiridos com a regulamentação empresarial. O embasamento da pesquisa consiste em informações presentes na legislação e portais eletrônicos responsáveis pela realização dos processos de órgãos públicos. Demonstrando que durante os momentos de instabilidade causada pela pandemia do COVID 19 tais benefícios foram um grande diferencial no momento o qual uma parte das empresas foram pegas financeiramente desprevenidas e só foi possível manter-se aqueles com situação jurídica favorável perante órgãos como bancos e financiadoras. Através desse estudo, pretende-se observar que, ainda que extenso e complexo existe um engajamento dos órgãos de todas as esferas envolvidas para desburocratizar e simplificar esse processo, com convênio entre estes diferentes órgãos com objetivo de integrá-los e otimizar o tempo e quantidade de documentos necessários como exemplo

This article describes the process of opening and regulating a micro-enterprise, of a legal nature, limited liability company with taxation under Simples Nacional in São José do Rio Preto/SP, steps described in the municipal, state and federal spheres. In order to demonstrate in a summarized way such opening stages in the municipality in question, the importance of the accounting professional during this process and the financial, judicial benefits, among many others acquired with business regulation. The basis of the research consists of information present in the legislation and electronic portals responsible for carrying out the processes of public bodies. Demonstrating that during the moments of instability caused by the COVID 19 pandemic, such benefits were a great differential at the time when a part of the companies were caught financially off guard and it was only possible to maintain those with a favorable legal situation before bodies such as banks and financiers. Through this study, it is intended to observe that, although extensive and complex, there is an engagement of bodies from all spheres involved to reduce bureaucracy and simplify this process, with an agreement between these different bodies in order to integrate them and optimize the time and quantity documents required, such as REDESIM (National Network for Simplifying the Registration and Location of Companies and Businesses).
