Proteção jurídica de dados pessoais sob a LGPD: enfrentando ameaças de roubo digital.

Abstract

A Lei Geral de Proteção de Dados (LGPD) N.13.709/18, é uma legislação que foi sancionada em 2018 e que tem como função estabelecer regras para o tratamento, compartilhamento e armazenamento de dados pessoais tanto em meio físico quanto em meio digital. O crime mais comum cometido contra a regulamentação da LGPD é o roubo de dados majoritariamente dispostos em redes sociais, que conectam dados em escala mundial, o que corrobora para com tais violações. Este presente trabalho tem como objetivo identificar os motivos pelos quais o roubo de dados ainda se faz muito presente na conjuntura brasileira atual, analisando a LGPD, tornando-se necessário apontar sua aplicação e expor as razões pela sua ineficácia. Esta pesquisa retrata a demonstração da proteção perante o roubo de dados pessoais na internet e em redes sociais, que se faz garantida pela legislação citada.

The General Data Protection Law (LGPD) N.13.709/18 is legislation that was sanctioned in 2018 and whose function is to establish rules for the processing, sharing and storage of personal data in both physical and digital media. The most common crime committed against LGPD regulations is the theft of data, mostly available on social networks, which connect data on a global scale, which corroborates such violations. This present work aims to identify the reasons why data theft is still very present in the current Brazilian situation, analyzing the LGPD, making it necessary to point out its application and explain the reasons for its ineffectiveness. This research demonstrates protection against the theft of personal data on the internet and social networks, which is guaranteed by the aforementioned legislation.
