Fake news: análise dos projetos de leis em tramitação no Congresso Nacional em 2020

Abstract

No contexto atual, podemos observar que as discussões relacionadas a Fake News, tem se propagado em diversos âmbitos, sobretudo no que diz respeito a suas consequências. As notícias com a intensão de enganar, tirando vantagem da desinformação de algumas pessoas para se obter ganhos financeiros ou beneficiando os meios políticos, são disseminadas através de meios de comunicações como pôr exemplo: Facebook, Twitter, Instagram, WhatsApp, entre outros. Com o crescimento tecnológico, muitos indivíduos começaram a ter contato com as redes sociais, fazendo com que os números incontáveis de usuários facilitem a ainda mais a “desinformação”, tendo em vista que qualquer informação compartilhada na rede atinge um número muito grande de usuários, uma vez que jogada na rede ficará mais complicado de retira-la. Por mais que não exista uma lei especifica para o termo Fake News, pede-se que a pessoa responsável pela disseminação seja punida em outras esferas como por exemplo calunia, difamação e injuria. Além de que já existe no Congresso Nacional vários projetos de leis que pretendem criminalizar a Fake News em várias áreas do direito, como Civil, Penal e Administrativo. In the current context, we can see that the discussions related to Fake News, has spread in several areas, especially with regard to its consequences. The news with the intention of deceiving, taking advantage of the misinformation of some people to obtain financial gains or benefiting the political means, is disseminated through means of communications such as: Facebook, Twitter, Instagram, WhatsApp, among others. With technological growth, many individuals began to have contact with social networks, making the countless numbers of users facilitate even more “misinformation”, given that any information shared on the network reaches a very large number of users, once thrown on the net it will be more complicated to remove it. As much as there is no specific law for the term Fake News, it is possible that the person responsible for the dissemination is punished in other spheres such as slander, defamation and insult. In addition to the fact that there are already several bills in the National Congress that intend to criminalize Fake News in various areas of law, such as Civil, Criminal and Administrative.
