Colaboração premiada: a aplicação da colaboração premiada no Direito Penal Brasileiro

Abstract

No Brasil existem vários meios para formular uma investigação e se alcançar o mérito no cumprimento da lei. Dentre elas,estão a delação premiada e colaboração premiada que de certa forma se confundem muito,nos apontamentos desse questionamento não será estranho o surgimento da pergunta: qual a diferença entre a delação e a colaboração premiada? O tema é delicado e não unânime no âmbito da doutrina, e para melhor entendimento será exposto a distinção entre eles,apontando todas as leis que expressam esse conteúdo. Como a colaboração premiada circula pelo meio jurídico existem diversas leis que a citam, e diferente do que muitos pensam a colaboração não é utilizada apenas nos crimes econômicos,mas também nos crimes de drogas,lavagem de dinheiro,crimes organizados,entre outros. Devido às consequências que esse tipo de investigação causa ao colaborador, para a proteção deste a lei de proteção a vítimas e testemunhas traz artigos que citam a colaboração e a forma com que esta deve ocorrer. Depois de todas as comprovações do acontecimento real do delito existem diversos requisitos que o réu deve se enquadrar para que ele possa realizar a colaboração premiada, caso isto ocorra ele terá diversos benefícios assegurados pela lei. Como tudo tem dois aspectos devem ser observados as partes negativas e positivas deste tipo de investigação. De fato este recurso traz diversas vantagens ao colaborador, e por conta disso o ministério público deve averiguar com muito cuidado a veracidade dos fatos para que não ocorram injustiças. In fact this resource brings several advantages to the collaborator, and because of this, the public prosecutor must carefully determine the truth of the facts so that no injustices occur.
