dc.description.abstractO presente artigo tem como principal objetivo uma analise mais aprofundada sobre a identificação do dolo eventual e da culpa consciente para auxiliar a compreensão e a distinção destes temas na área trabalhista. O dolo eventual refere- se à situação em que o agente não deseja diretamente o resultado danoso, mas aceita o risco de que esse resultado possa ocorrer como consequência de suas ações. Por outro lado, a culpa consciente envolve a negligência grave do agente, que está ciente do risco de dano, mas age de forma irresponsável, não tomando as devidas precauções. A pesquisa explora como a segurança dos trabalhadores deve ser uma preocupação primordial. A identificação do dolo eventual e da culpa consciente mostrará se o empregador está agindo com negligência ao expor os funcionários a riscos graves. Além disso, este artigo cientifico apresenta uma análise aprofundada, fornecendo percepções valiosas para juristas, acadêmicos e legisladores que desejam compreender melhor esses conceitos no âmbito da responsabilidade civil e criminal em relação ao ambiente laboral.pt_BR
dc.description.abstractThe present article aims to provide a more in-depth analysis of identification of eventual intent and guilt-awareness in order to help understand and distinguish these concepts within the labor field. Eventual intent refers to the situation in which the agent does not directly desire the harmful outcome but accepts the risk that such an outcome may occur as a consequence of their actions. On the other hand, guilt-awareness involves the agent's grave negligence, where they are aware of the risk of harm but act irresponsibly, failing to take the necessary precautions. The research explores how worker safety should be a primary concern. Identifying eventual intent and guilt-awareness will determine whether the employer is engaging in negligent conduct by exposing employees to significant risks. Furthermore, this academic publication conducts a thorough investigation, providing valuable insights for legal professionals, academics, and policymakers wishing to gain a deeper appreciation of these concepts in the context of both civil and criminal responsibilities at work.pt_BR
