Perspectivas de combate ao racismo na sociedade brasileira

Abstract

O presente trabalho inicialmente tinha como tema o estudo do papel da justiça no combate ao racismo, porém, durante a evolução da pesquisa o tema central foi definido como caminhos para superação do racismo. Neste trabalho, proponho uma análise jurídica sobre o racismo na sociedade brasileira no tocante a efetividade das leis que versam sobre a questão racial como as leis de cotas, o estatuto da igualdade racial. Procurei abordar inicialmente os conceitos de justiça e de direito e também qual o conceito e definição de racismo.Logo após, procurei estudar as raízes do racismo no Brasil e também medidas de suborno racial.Posteriormente a isso, passei a analisar a efetividade das normas jurídicas anti-racistas e também se a criminalização do racismo foi de fato efetiva. Em meu trabalho também me preocupei em pensar a questão da esterilização de mulheres negras, fato histórico e social muito importante para pensarmos a questão racial no Brasil.Após, uma série de recortes foram feitos como o do racismo com mulheres negras, o racismo nos presídios femininos e a LGBTfobia.Também foi tema de nossa pesquisa o estudo de o Estado era de fato capaz de combater o racismo, partindo para uma análise do genocídio negro e também sobre como surge o racismo no Brasil e o discurso legitimador do racismo entoado pela Igreja Católica.Depois, analisei formas de combate a estes discursos legitimadores e também os motivos da persistência do racismo em nossa sociedade.Analisei a seletividade do sistema penal.Analisei também a cultura do punitivismo e sua relação com o racismo.Também foi alvo de nossa pesquisa o justiçamento como uma expressão do racismo em nossa sociedade.Tive a oportunidade de estudar a ineficiência da ressocialização de presos no Brasil e a desumanização do cárcere.E também propûs uma teorização sobre auto-amor e afetividade como formas de resistência.Também foi alvo de nossos estudos a tortura nos presídios como manifestação do racismo. Sobre o encarceramento crescente de mulheres negras.Abordei também a questão dos programas policiais e sua relação com o racismo, bem como o populismo penal e a relação entre guerra às drogas e racismo. Estudei também casos como o de Marielle Franco e Luana Barbosa e sua contribuição para entender como o racismo e a necropolítica se unem em prol do genocídio do povo negro. Analisei também caso emblemático de como Rafael Braga e sua prisão representam a arbitrariedade racista de nosso sistema penal. Estudei também representatividade, empoderamento, cotas e aquilombamento como caminhos para a superação do racismo Estudei também e tive cuidado para incentivar a busca do Ministério Público e as Ouvidorias no combate ao racismo. E por fim, me dediquei a teorizar sobre a necessidade da fagulha anti-racista como um caminho para a superação do racismo.

The present work initially had as its theme the study of the role of justice in the fight against racism, however, during the evolution of the research the central theme was defined as ways to overcome racism.In this paper, I propose a legal analysis of racism in Brazilian society regarding the effectiveness of laws that deal with racial issues such as quota laws, the statute of racial equality.I sought to address initially the concepts of justice and law and also the concept and definition of racism.Soon after, I sought to study the roots of racism in Brazil and also measures of racial bribery.Subsequently, I began to analyze the effectiveness of anti-racist legal norms and also whether the criminalization of racism was indeed effective.In my work, I also worried about thinking about the sterilization of black women, a very important historical and social fact to think about the racial issue in Brazil. Then a series of clippings were made such as racism with black women, racism in women's prisons, and LGBTphobia.Also the subject of our research was the study of the state was in fact capable of combating racism, starting with an analysis of black genocide and also about how racism arises in Brazil and the legitimizing discourse of racism sung by the Catholic Church.Then I looked at ways to combat these legitimizing discourses and also the reasons for the persistence of racism in our society.I analyzed the selectivity of the penal system.I also analyzed the culture of punitivism and its relation to racism.Our research also focused on justification as an expression of racism in our society.I had the opportunity to study the inefficiency of prisoner resocialization in Brazil and the dehumanization of prison.It also proposed a theorizing about self-love and affectivity as forms of resistance.Our studies also targeted prison torture as a manifestation of racism.About the increasing incarceration of black women.I also addressed the issue of police programs and their relationship to racism, as well as criminal populism and the relationship between drug war and racism.I also studied cases such as Marielle Franco and Luana Barbosa and their contribution to understanding how racism and necropolitics unite for the genocide of the black people.I also analyzed an emblematic case of how Rafael Braga and his arrest represent the racist arbitrariness of our penal system.I also studied representativeness, empowerment, quotas and aquilombamento as ways to overcome racism.I also studied and was careful to encourage the pursuit of the Public Prosecution Service and the Ombudsman to combat racism.Finally, I dedicated myself to theorizing about the need for the anti-racist spark as a way to overcome racism.
