Lei Maria da Penha e a ineficácia das medidas protetivas

Abstract

O trabalho teve como objetivo geral identificar se as medidas protetivas aplicadas são eficientes na prática, e se evitam futuras agressões. Como resultado do trabalho, por meio de pesquisas e entrevistas, obtivemos que as medidas protetivas são eficazes em Itararé/SP, evitando novas agressões, entretanto, muitas vezes o agressor entra em contato com a vítima mesmo estando com a medida protetiva. Percebe-se também que diversas mulheres não têm conhecimento de seus direitos ou até mesmo vergonha de realizar a denúncia. Identificar a ineficácia das medidas protetivas por meio de pesquisas de campo: uma semiestruturada com a Guarda Civil Municipal de Itararé, outra estruturada com as mulheres e cidadãos em geral de Itararé, coletando dados e depoimentos, além de pesquisas bibliográficas por meio de artigos e livros, assim adquirindo mais informações. Em conclusão, por meio do desenvolvimento deste artigo, foi possível aprofundar o conhecimento do grupo diante tal tema, sabendo como o mesmo se comporta no nosso município. Destaca-se que tal assunto ainda é pouco explorado na sociedade, trazendo mais desinformação, o que gera ignorância na população, que por muitas vezes não realizam a denúncia, ou até mesmo retiram as medidas por falta de conhecimento ou medo do agressor. Sendo assim, a Lei Maria da Penha deveria ser mais divulgada nos meios de comunicação, e o governo de Itararé-SP deveria criar uma Delegacia da Mulher no município.

The general aim of the work was to identify whether the protective measures applied are effective in practice and whether they prevent future aggression. As a result of the work, through research and interviews, we found that the protective measures are effective in Itararé/SP, preventing further aggression, however, the aggressor often contacts the victim even though the protective measure is in place. It is also clear that many women are not aware of their rights or are even ashamed to report them. Identifying the ineffectiveness of protective measures through field research: one semi-structured with the Itarare Municipal Civil Guard, another structured with women and citizens in general from Itararé, collecting data and testimonies, as well as bibliographical research through articles and books, thus acquiring more information. In conclusion, through the development of this article, it has been possible to deepen the group's knowledge of the subject, knowing how it behaves in our municipality. It is noteworthy that this subject is still little explored in society, bringing more misinformation, which generates ignorance in the population, who often do not file a complaint, or even withdraw the measures due to lack of knowledge or fear of the aggressor. As such, the Maria da Penha Law should be better publicized in the media, and the government of Itarare-SP should create a Women's Police Station in the municipality.
