Liberdade de expressão e discurso de ódio: o limite entre o direito e o abuso.

Abstract

Um dos direitos fundamentais assegurados por diversas constituições ao redor do mundo, abrangendo a constituição brasileira, é a da Liberdade de expressão. Além de ser significativa do ponto de vista constitucional, ela constitui um elemento fundamental para o diálogo público, a diversidade de perspectivas e a formação de uma opinião democrática. Entretanto, seu uso total não é ilimitado, pois se confronta com outros direitos igualmente resguardados, como o direito à honra, à igualdade e, principalmente, à dignidade humana. Logo, este trabalho tem como objetivo analisar o limite do direito do uso da liberdade de expressão e as relações com o discurso de ódio presentes no nosso país. A pesquisa, de caráter dedutivo, foi realizada, por meio de análise crítica de obras acadêmicas, artigos científicos, legislações, decisões judiciais e doutrina especializada. Os resultados indicaram uma correlação positiva entre uma percepção clara dos limites da liberdade de expressão, especialmente na identificação do discurso de ódio como uma violação que deve ser combatida por suas consequências sociais negativas. Dessa forma, conclui-se que, após analisar os dados e o conceito do direito à liberdade de expressão, este não é um direito sem limites. Como o Discurso de Ódio é reconhecido como um abuso no direito de liberdade de expressão, concluímos que esse tipo de discurso prega o preconceito, sendo considerado crime. Ou seja, o mau uso desse direito merece limitações e sanções, para que se proteja direito alheio, como dignidade e honra. Palavras-chave: Liberdade de expressão. Discurso de ódio. ABSTRACT One of the fundamental rights guaranteed by several constitutions around the world, including the Brazilian constitution, is Freedom of expression. In addition to being significant from a constitutional point of view, it constitutes a fundamental element for public dialogue, diversity of perspectives and the formation of a democratic opinion. However, its total use is not unlimited, as it conflicts with other equally protected rights, such as the right to honor, equality and, mainly, human dignity. Therefore, this work aims to analyze the limits of the right to use freedom of expression and the relationship with hate speech present in our country. The research, of a deductive nature, was carried out through critical analysis of academic works, scientific articles, legislation, judicial decisions and specialized doctrine. The results indicated a positive correlation between a clear perception of the limits of freedom of expression, especially the identification of hate speech as a violation that must be combated due to its negative social consequences. Therefore, it is concluded that, after analyzing the data and the concept of the right to freedom of expression, this is not a right without limits. As Hate Speech is recognized as an abuse of the right to freedom of expression, we conclude that this type of speech preaches prejudice and is considered a crime. In other words, the misuse of this right deserves limitations and sanctions, so that other people's rights, such as dignity and honor, are protected. Keywords: Freedom of expression. Hate speech.
