Responsabilidade civil por abandono afetivo

Abstract

O presente trabalho tem como objetivo, a partir da análise da doutrina e da jurisprudência buscar uma solução entre o convívio entre pais e filhos preceituado no princípio da dignidade humana. è certo que não se pode obrigar ninguém a dar carinho, atenção e afeto, porém quando o mais interessado deste direito (a criança) sofre as consequências desse abandono afetivo, este sujeito poderá recorrer ao judiciário para que seja, pelo menos em parte amenizado a sua dor. ABSTRACT This work aims, through the analysis of doctrine and jurisprudence, to seek a solution regarding the relationship between parents and children as stipulated in the principle of human dignity. It is true that no one can be forced to give affection, attention, and love; however, when the party most interested in this right (the child) suffers the consequences of this emotional abandonment, this individual may resort to the judiciary to have their suffering, at least in part, alleviated.
