Um estudo sobre a união estável e os direitos legais em caso de separação

Abstract

As formas de constituição de entidades familiares têm passado por transformações significativas ao longo dos anos, e a união estável passou a ser reconhecida pela legislação brasileira, bem como os direitos e deveres dos cônjuges, inclusive sobre as questões relacionadas a guarda dos filhos, o que antigamente não existia. Tendo em vista a importância do assunto, este trabalho aborda questões teóricas, legais e práticas, as quais podem orientar e sanar dúvidas da sociedade de uma forma geral. Tal estudo encontra-se organizado a partir de pesquisas bibliográficas e na legislação, que permitiram a compreensão sobre as peculiaridades da união estável. Além disso, foi feita uma pesquisa de campo junto a população palmitalense, a qual foi fundamental para identificar as principais dúvidas das pessoas, bem como os melhores canais de comunicação para divulgar informações sobre o assunto. A partir dos resultados foram criadas formas estratégicas para minimizar o problema, tais como divulgação de informações em artigo em jornal e em redes sociais.

The ways in which family entities are formed have undergone significant transformations over the years, and stable unions have come to be recognized by Brazilian legislation, along with the rights and duties of partners, including issues related to child custody—something that did not exist in the past. Given the importance of the topic, this work addresses theoretical, legal, and practical issues that can guide and clarify doubts for society in general. This study is organized based on bibliographic research and legislation, which made it possible to understand the particularities of stable unions. In addition, field research was conducted with the population of Palmital, which was essential to identify people’s main doubts, as well as the best communication channels to disseminate information on the subject. Based on the results, strategic approaches were created to minimize the problem, such as sharing information through newspaper articles and social media.
