A importância da implantação da guarda civil ambiental no município de Itapetininga

Abstract

O trabalho tem como objetivo geral demonstrar a importância da guarda civil municipal ambiental, destacando suas vantagens e desvantagens, para criação do grupamento especializado na cidade de Itapetininga. Os objetivos específicos são: realizar uma revisão bibliográfica sobre a importância e o papel das guardas ambientais municipais; descrever o ordenamento jurídico e institucional da atuação das guardas civis municipais; fazer um levantamento de casos de municípios onde já tenham implantado esse patrulhamento; identificar as ocorrências e as principais demandas dos serviços de proteção ambiental no município de Itapetininga; mostrar as vantagens e desvantagens que serão adquiridas com a criação da guarda ambiental na cidade. A metodologia a ser utilizada, trata-se de pesquisa, ao mesmo tempo, bibliográfica, documental e estudo de caso. Classifica-se como bibliográfica, pois recorre ao uso de material acessível ao público em geral, como livros, artigos e as legislações já publicadas e disponibilizadas da internet. A pesquisa também é documental, porque está baseada em relatórios fornecidos pela Policia Ambiental da cidade de Itapetininga, da Secretaria do meio ambiente e de Postura do município, que forneceram as informações necessários para o estudo de caso. Portanto, conclui-se que a Guarda Municipal tem a missão de proteger o patrimônio ecológico, atuando no espaço público, parques, monumentos históricos, com ações e práticas educativas voltadas a conservação do meio ambiente, mas os resultados mostram que a forma de atuação dos Guardas Municipais é insatisfatória, devido à falta de entendimento por parte dos agentes sobre suas atribuições para atuar na área especifica. Recomenda-se que os gestores equipem suas corporações para que seja possível exercer a atividade fazendo com que essa categoria seja um instrumento da política ambiental em nível municipal.

The general objective of this work is to demonstrate the importance of the municipal environmental guard, highlighting its advantages and disadvantages, for the creation of a specialized group in the city of Itapetininga. The specific objectives are: to conduct a bibliographic review on the importance and role of municipal environmental guards; to describe the legal and institutional framework of the actions of municipal civil guards; to conduct a survey of cases in municipalities where this patrolling has already been implemented; to identify the occurrences and main demands of environmental protection services in the municipality of Itapetininga; to show the advantages and disadvantages that will be acquired with the creation of the environmental guard in the city. The methodology to be used is a bibliographic, documentary, and case study research. It is classified as bibliographic because it uses material accessible to the general public, such as books, articles, and legislation already published and available on the internet. The research is also documentary, because it is based on reports provided by the Environmental Police of the city of Itapetininga, the Municipal Department of the Environment and Public Order, which provided the necessary information for the case study. Therefore, it is concluded that the Municipal Guard has the mission of protecting ecological heritage, acting in public spaces, parks, historical monuments, with educational actions and practices aimed at environmental conservation, but the results show that the way the Municipal Guards operate is unsatisfactory, due to a lack of understanding on the part of the agents about their duties to act in the specific area.

It is recommended that managers equip their corporations so that it is possible to carry out the activity, making this category an instrument of environmental policy at the municipal level.
