Aplicabilidade da medida socioeducativa no território do Jardim Ângela

Abstract

O presente trabalho versa a percepção sobre as medidas socioeducativas aplicadas aos adolescentes em conflito com a lei no território do Jardim Ângela, abordando os principais temas e princípios norteadores do Estatuto da Criança e do Adolescente, bem como as características da aplicação das medidas socioeducativas na prática. O objetivo é compreender o papel da família, do Estado e da sociedade na ressocialização desses jovens infratores e analisar o alcance e os desafios enfrentados pela medida socioeducativa, a carta magna sendo nossa lei maior, na constituição federal estabelece no art. 227 esses três pilares como responsáveis pela formação e estruturação desses indivíduos como cidadão. Com a finalidade de perfazer que esse jovem infrator repare o dano causado a sociedade, a medida socioeducativa em conjunto com o poder judiciário, e a secretária da assistência social, em parceria com entidades não governamentais, executa o cumprimento da medida socioeducativa, sujeitando inclusive às sanções previstas no ECA. Este estudo foi realizado por meio de uma revisão bibliográfica, com a elaboração de formulário para pesquisa online, com a finalidade de coletar dados. Durante a pesquisa foi possível concluir que os resultados indicam que, apesar dos avanços legais, ainda existem grandes desafios na eficácia do processo de ressocialização por meio dessas medidas, um dos principais fatores que colaboram para a falta de assertividade nas práticas socioeducativas, é a ausência de investimento em espaços de qualidade com a infraestrutura adequada, e recursos financeiros para que as instituições responsáveis na aplicação das medidas possam garantir com qualidade o serviço prestado a população vulnerável. É importante destacar a fomentação de diálogo e a participação dos adolescentes em todas as etapas do processo socioeducativo para uma efetiva ressocialização, ou seja, embora haja avanços, é necessário um olhar crítico e constante a fim de garantir o pleno cumprimento da garantia dos direitos desses jovens e uma efetiva reintegração na sociedade. Diante do exposto concluímos que apesar de identificarmos por meio desta pesquisa avanços significativos na criação de políticas públicas que garantem a eficácia no processo de ressocialização de crianças e adolescentes em conflito com a lei, ainda existe uma grande defasagem na capitalização de recursos específicos. Ao pensarmos em medidas socioeducativas, entendemos que se faz necessário a criação de debates com o intuito de elucidar a população a cerca dessa temática, ainda pouco discutida, mas que se faz tão necessária na sociedade,

The present work deals with the perception of the social-educational measures applied to adolescents in conflict with the law in Jardim Ângela área, approaching the main topos and guiding principles of the Child and Adolescent Statute as well as the characteristics of the application of social-educational measures in practice. The objective is to understand the role of the family, the State, and society in the resocialization of these young offenders and analyzes the scope and challenges faced by the socio-educational measure, the Magna Carta being our highest law, in the federal constitution establishes in article 227 these three pillars as responsible for the formation and structuring of these individuals as citizens. In order to ensure that this young offender repairs the damage caused to society, the social-educational measure in conjunction with the judiciary, and the Social Services Assistance, in partnership with non-governmental entities, executes the fulfilment of the social-educational measure, including subjecting it to the sanctions provided for in the ECA.

This study was carried out through a bibliographical review, development of a form for online research with the purpose of collecting data. During the research it was possible to conclude that the results indicate that, despite the legal advances, there are still great challenges in the effectiveness of the resocialization process through these measures, one of the main factors that contribute to the lack of assertiveness in socio- educational practices, it's the lack of investment in quality spaces with the appropriate infrastructure, and financial resources so that the institutions responsible for implementing the measures can guarantee the quality of the service provided to the vulnerable population. It is important to highlight the promotion of dialogue and the participation of adolescents in all stages of the social-educational process for effective resocialization. It is concluded that, although there are advances, a critical and constant look is necessary in order to ensure complete compliance with the guarantee of the rights of these young people and an effective reintegration into society. Given the above, we conclude that although we identified through this research significant advances in the creation of public policies that guarantee the effectiveness in the process of resocialization of children and adolescents in conflict with the law, there is still a large gap in the capitalization of specific resources.

When we think about social-educational measures, we understand that it is necessary to create debates instead of educating population about this topic, which is still little discussed, but which is so necessary in society. The results indicate that, despite legal advances, there are still challenges to the effectiveness of resocialization through these measures, due to problems such as the lack of adequate structure in institutions, the lack of resources, and social inequality that directly affects this population.
