Personalidade jurídica.

Abstract

A personalidade jurídica é a efetivação total de direitos que adquirimos a partir do nascimento com vida. Ser essa atribuída ao nascituro, ou seja, àquele que ainda está para nascer, é um assunto controverso que abre espaço a debates sobre as garantias pertencentes ao feto. Na atual sociedade, onde assuntos referentes ao aborto ganham mais notoriedade a cada dia, tornou-se necessário entender, de maneira geral, quais direitos pertencem ao embrião, quais são as leis referentes a ele e como são defendidas em julgados. Foi necessário conhecer seu contexto histórico e acompanhar sua evolução na esfera civil e penal, compreender quais são as teorias referentes à personalidade e qual é adotada pelo Brasil, esclarecendo e simplificando o entendimento sobre quais privilégios atribuídos ao nascituro eram fundamentais e quais eram materiais.

Legal personality is the full realization of rights that we acquire from birth with life. So this attributed to the unborn, in other words, to the one that is still to be born, is a controversial subject that opens space to debates on the guarantees belonging to the fetus. In today's society, where subjects pertaining to abortion gain more prominence each day, it has become necessary to understand, in a general way, what rights belong to the embryo, what laws are related to it and how they are defended in the courts. It was necessary to know its historical context and to follow its evolution in the civil and penal sphere, to understand which are the theories referring to the personality and which is adopted by Brazil, clarifying and simplifying the understanding on which privileges assigned to the unborn were fundamental and which were material.
