Abstract

A pessoa que sofre de transtornos mentais e comete um crime, desde que haja um nexo causal entre a doença e o delito, deve, por determinação judicial cumprir seu tratamento em hospitais de custódia e tratamento psiquiátrico. O presente artigo consiste em analisar se há estabelecimentos específicos o suficiente para doentes que cometeram crimes, e se, por vezes, ficam em presídios comuns ou até mesmo em hospitais de custódia, mas sem o devido tratamento. Através de métodos qualitativos utilizando das pesquisas bibliográficas, web gráfica, entrevista, e métodos quantitativos com a pesquisa de campo, para analisar se a sociedade conhece os direitos dos doentes mentais e levar informação a estes. Os resultados revelaram que nem todos possuem o conhecimento adequado sobre o assunto. Concluímos também que os direitos são garantidos por lei, mas na maioria das vezes não são cumpridos da maneira correta. O Estado não está fornecendo o investimento adequado aos Hospitais de Custódia e aos diagnósticos de doenças.

The person suffering from mental disorders and committing a crime, as long as there is a causal link between the illness and the crime, must by judicial determination comply with their treatment in custodial hospitals and psychiatric treatment. The present article consists of analyzing whether there are enough specific establishments for patients who have committed crimes, and if they sometimes stay in ordinary prisons or even in custodial hospitals, but without proper treatment. Through qualitative methods, using bibliographical research, graphic web, interview, and quantitative methods with field research, to analyze whether society knows the rights of the mentally ill and bring information to them. The results revealed that not everyone has the proper knowledge on the subject. We also conclude that rights are guaranteed by law, but most of the time they are not fulfilled in the right way. The State is not providing adequate investment to Custody Hospitals and diagnoses of diseases.
