Liberdade de expressão e ataques aos direitos fundamentais advindos de meios digitais

Abstract

A evolução da sociedade torna essencial a adequação das regras de convívio nos mais diversos meios de comunicação e interação, inclusive, a internet, necessitando de regras para tornar o meio digital um ambiente seguro, respeitando as culturas e escolhas de todos, baseandose nos direitos fundamentais e nas leis estabelecidas. O considerável avanço do meio tecnológico e a crescente popularização da internet em todo o mundo desfizeram as barreiras em torno da telecomunicação e introduziu globalmente, a disseminação de informações e conteúdos, opiniões e ideias. Este artigo científico abrange problemáticas relacionadas à propagação de ódio e ao descumprimento dos direitos fundamentais, que surgem em decorrência das relações e interações entre usuários da comunidade. Tendo isso em vista, surge o questionamento de até aonde a liberdade se estende nesse âmbito.

The evolution of society has made it essential to adapt the rules of coexistence in the most diverse means of communication and interaction, including the Internet, requiring rules to make the digital environment a safe environment, respecting everyone's cultures and choices, based on fundamental rights and established laws. The considerable advance of the technological medium and the increasing popularization of the internet worldwide has broken down the barriers around telecommunication and introduced globally, the dissemination of information and content, opinions and ideas. This scientific article covers issues related to the spread of hate and the nonobservance of fundamental rights, which arise as a result of the relationships and interactions between community users. With this in mind, the question arises as to how far freedom goes in this area. Freedom of expression is a basic guarantee, recognized as a fundamental right in the Federal Constitution. However, it does not mean that this right is absolute and that this nontotality means lack of democracy, because the use of freedom of speech to carry out hate speech, especially against social minorities, is not in accordance with other rights provided in the Brazilian legislation, such as the fundamental right to equality and the right to human dignity. Thus, the right to liberty does not relieve the practitioner of his or her respective penalty.
