Violência doméstica contra a mulher.

Abstract

Neste presente estudo, buscamos debater sobre o tema “Violência Doméstica Contra Mulher” na atualidade, que lamentavelmente ainda é um grande tabu diante a sociedade sustentada em todo transcorrer da história, de modo que perpasse todas as classes sociais e atinja numerosos lares em todo o mundo. Resultante o atual período de pandemia, no qual mulheres passam maior tempo dentro de seus lares juntamente ao seu agressor, ocorreu um aumento significativo em índices de agressões, que só tendem crescer assustadoramente nesse período, favorecendo também feminicídios dentro do Brasil. Este crime tem gerado tormento no momento atual, mais do que já fazia anteriormente. Mesmo com a efetivação da lei 11340/2006, conhecida como “Lei Maria da Penha”, com a finalidade a proteção à mulher e garantia da justiça contra ao agressor, para que ele se redima por tal crime. Infelizmente os casos não se extinguiram em totalidade, faltando um meio mais eficaz e rápido para o combate à este crime, de forma que a lei não gere amedrontamento ou temor, impedindo que esses agressores o pratiquem com o pensamento de que não pagarão por isso. O presente trabalho aborda a adversidade e desigualdade que as mulheres sofrem desde o princípio, com uma imagem sobre elas totalmente dissemelhante e inadmissível, um fato que ocorre desde a criação de homens e mulheres, e infelizmente ainda recorrente nos dias atuais, quando torna-se inacreditável o fato de que tantos homens ainda são machistas ao ponto de praticarem diversidade, desigualdade e injustiça com o sexo feminino. Foi abordado também neste estudo a importância dessas vítimas conseguirem se desvincular de seus agressores e de denunciar, além dos mecanismos nela encontrados, oferecendo amparo e proteção para as vítimas e seus familiares. O objetivo deste trabalho é fazer uma análise crítica em seus aspectos constitucionais, e de olhar humanista perante ao tema, interpretando frente à realidade social a favor das vítimas, vez que são consideradas coniventes e em muitos dos casos não são de fato vistas como vítimas, e sim julgadas como um coautor, buscando justificar o crime. Com isso, busca se ressaltar a importância das mulheres não se calarem e denunciarem, pois mesmo com tantos julgamentos a sua volta, nenhuma mulher merece permanecer em um relacionamento assim, nenhuma mulher merece apanhar, além de evidenciar que a vítima não é culpada e mostrar que não existem justificativas para a agressão, independente de qual seja sua forma. O trabalho foi dividido em quatro capítulos, os quais abordaram os aspectos históricos da conquista de direitos da mulher, formas de violência contra mulher, epidemia de violência contra mulher durante a pandemia, políticas e legislações de proteção à mulher e, por fim, conclusão. Com isso, é possível inferir que ainda se tem um longo caminho pela frente até alcançar a igualdade que merecida, lutando diariamente para que essa sociedade machista descontrua pensamentos asquerosos que condenem as mulheres a submetem-se a determinadas situações apenas por serem mulheres, seres considerados frágeis e insuficientes. Tais imposições tornaram-se insuportáveis, o sexo feminino não pode se calar nem recuar agora, pois mesmo que demore a concretização dessa mudança, sabe-se que o caminho está correto, mesmo que ela ainda seja lenta para a extinção de pensamentos, atitudes e seres humanos como tais. Denunciar é essencial para a manutenção dessa luta, assim não se sentindo sozinha e desamparada, visando sair desse ciclo vicioso.

In this present study, we seek to debate the theme "Domestic Violence Against Women" today, which unfortunately is still a great taboo in the face of society sustained throughout history, so that it permeates all social classes and reaches numerous homes in Worldwide. As a result of the current pandemic period, in which women spend more time in their homes together with their aggressor, there has been a significant increase in aggression rates, which only tend to grow alarmingly in this period, also favoring feminicides within Brazil. This crime has generated torment at the present time, more than it ever did before. Even with the enforcement of law 11340/2006, known as the “Maria da Penha Law”, with the purpose of protecting women and guaranteeing justice against the aggressor, so that he redeems himself for such a crime. Unfortunately, the cases have not been completely extinguished, and there is a lack of a more effective and quick way to combat this crime, so that the law does not generate fear or fear, preventing these aggressors from practicing it with the thought that they will not pay for it. The present work addresses the adversity and inequality that women suffer from the beginning, with an image about them totally dissimilar and inadmissible, a fact that occurs since the creation of men and women, and unfortunately still recurring today, when it becomes unbelievable the fact that so many men are still sexist to the point of practicing diversity, inequality and injustice with the female sex. This study also addressed the importance of these victims being able to detach themselves from their aggressors and to report, in addition to the mechanisms found in it, offering support and protection for victims and their families. The objective of this work is to make a critical analysis in its constitutional aspects, and a humanist look at the theme, interpreting it in the face of social reality in favor of the victims, since they are considered colluding and in many cases are not in fact seen as victims, but rather judged as a co-author, seeking to justify the crime. With this, we seek to emphasize the importance of women not to be silent and denounce, because even with so many judgments around them, no woman deserves to stay in a relationship like this, no woman deserves to be beaten, besides showing that the victim is not guilty and show that there are no justifications for the aggression, regardless of its form. The work was divided into four chapters, which addressed the historical aspects of the achievement of women's rights, forms of violence against women, the epidemic of violence against women during the pandemic, policies and legislation to protect women and, finally, conclusion. With this, it is possible to infer that there is still a long way to go before reaching the equality that deserved, fighting daily for this macho society to relax nasty thoughts that condemn women to submit to certain situations just because they are women, beings considered fragile and insufficient. Such impositions have become unbearable, the female gender cannot remain silent or retreat now, because even if it takes time for this change to take place, it is known that the path is correct, even if it is still slow for the extinction of thoughts, attitudes and human beings as such. Denouncing is essential for the maintenance of this fight, so not feeling alone and helpless, aiming to get out of this vicious cycle.
