Abstract

Assim como a sociedade se aprimora e avança tecnologicamente, também acompanham esses métodos aqueles que procuram os meios mais fáceis para ganhar suas vidas. Este avanço da tecnologia na área de informática provocou uma grande revolução nas relações sociais. As facilidades alcançadas pelo uso do computador e, principalmente, a Internet, transformaram a vida moderna. É a era da informática. Estas inovações propiciaram o aparecimento de novos tipos de crimes ou novas formas de praticar os já conhecidos tipos penais, surgindo os crimes de informática ou "cybercrimes". Assim, crime de informática é aquele praticado contra o sistema de informática ou através deste, compreendendo os praticados contra o computador e seus acessórios e os perpetrados através do computador. Inclui-se neste conceito os delitos praticados através da internet, pois pressuposto para acessar a rede é a utilização de um computador. São estes novos crimes praticados de alguns anos até a atualidade, cometidos através destas novas tecnologias, que vêm causando certo furor e em certos locais atingido um status bem problemático. Causando rombos financeiros, prejudicando sistemas em companhias, instituições governamentais e até mesmo um simples computador pessoal na casa de seu proprietário, não estão longe dos riscos e ações dos "cybercriminosos". Assim surge a necessidade também de a Legislação do Brasil valendo-se da ciência do Direito de crescer e acompanhar a evolução destas tecnologias e este novo cenário ilegal que aparece, atualizando-se e defendendo os direitos daqueles que forem vítimas destes novos criminosos.

This advance of the technology in the area of computer science provoked a great revolution in the social relations. The easiness reached for the use of the computer and, mainly, the InterNet, had transformed the life modern. It is the age of computer science. These innovations had propitiated the appearance of new types of crimes or new forms to practise already known types criminal, appearing the crimes of computer science, or cybercrimes. Thus, computer science crime is that one practised against the system of computer science or through this, understanding practised against the computer and the its accesories and the perpretrated ones through the computer. One includes in this concept the delicts practised through the InterNet, therefore estimated to have access the net it is the use of a computer. They are these new crimes practised of some years until the present time, committed through these new technologies, that come causing certain fury and in certain places reached a well problematic status. Causing financial gaps, harming governmental systems in company, institutions and even though a simple personal computer in the house of its proprietor, is not far of the risks and action of the cyber-criminals. Thus the necessity appears also of the Legislation of Brazil using itself of the science of the Law to grow and to follow the evolution of these technologies and this new illegal scene that appears, modernizing themselves and defending the rights of that they will be victims of these new criminals.
