Sistema penitenciário: o governo e os direitos humanos.

Abstract

O presente trabalho tem por objetivo analisar a inércia do Governo em relação ao sistema penitenciário e o que isso tem como consequência na aplicação das leis vigentes. Sendo assim, será analisado a evolução das Constituições Federais no Brasil, a comparação das diferentes realidades no tratamento nas penitenciárias ao redor do mundo, a exposição e contradição entre a teoria e a prática da lei e como o tratamento que os detentos recebem tem ligação direta com o surgimento de facções. As técnicas de estudo a serem utilizadas será: entrevista com um profissional do direito e uma pessoa que vive na prática tal problemática. Os resultados obtidos revelaram que tal temática é pouco debatida e reverbera na atual sociedade brasileira, pois os indivíduos não possuem conhecimento necessário acerca do sistema que rege às penitenciárias brasileiras. Segundo a escritora brasileira Djamilla Ribeiro, para atuar sobre um problema, é preciso tirá-lo da invisibilidade.

This paper aims to analyze the inertia of the Government in relation to the prison system and what this has as a consequence in the application of existing laws. Therefore, it will analyze the evolution of the Federal Constitutions in Brazil, the comparison of different realities in the treatment in penitentiaries around the world, the exposure and contradiction between the theory and practice of the Law and how the treatment that inmates receive is directly linked to the emergence of factions. The study techniques to be used will be: interviews with a legal professional and a person who experiences this problem in practice. The results obtained reveal that this theme is little discussed and reverberates in the current Brazilian society, because individuals do not have the necessary knowledge about the system that governs the Brazilian penitentiaries. According to the Brazilian writer Djamilla Ribeiro, in order to act on a problem, it is necessary to take it out of invisibility.
