Abstract: Em 2003, estatísticas do IBGE apontavam mais de dez milhões de empreendedores informais atuando no Brasil: números que chamaram a atenção do governo por anos. Visando reduzir essa realidade, o Governo Federal lançou a Lei Complementar nº 123/2006 que trouxe a simplificação na arrecadação e a redução da carga tributária para as micro e pequenas empresas. Contudo, a ação ainda não favorecia a categoria de profissionais autônomos com pequenos empreendimentos que não comportavam arcar com os custos da proposta. Neste cenário, surge a figura do Microempreendedor Individual (MEI) com a criação da Lei Complementar n° 128/2008, em vigor desde julho/2009, que possibilitou a esta classe a legalização da atividade informal por um custo fixo e mais acessível, com menos burocracia, as vantagens da pessoa jurídica e os benefícios previdenciários para o empreendedor e seus dependentes. Este ato refletiu significativamente na sociedade brasileira: tanto na economia como na questão social. Hoje, somam-se quase quinze milhões de microempreendedores formalizados. Este artigo busca compreender a relação entre os benefícios e as garantias do programa de formalização do microempresário que motivou a adesão não somente dos pequenos empreendedores informais como também de muitos brasileiros estimulados a empreender diante das crises no mercado de trabalho.
In 2003, statistics from the Brazilian Institute of Geography and Statistics (IBGE) indicated more than ten million informal entrepreneurs operating in Brazil: numbers that caught the government's attention for years. Aiming to reduce this reality, the Federal Government launched the Lei Complementar nº 123 of 2006, which brought the simplification in the tax collection and the reduction of the tax burden for the micro and small companies. However, this action still did not favor the category of autonomous professionals with tiny businesses that could not afford the costs of the proposal. In this context, the figure of the Individual Microentrepreneur (MEI) arises with the creation of the Lei Complementar nº 128 of 2008, in vigor since July of 2009, which allowed this class to legalize its informal activity for a fixed and more accessible cost, with less bureaucracy, the advantages of a legal entity and the social security benefits for the entrepreneur and its dependents. This act reflected significantly on Brazilian society: both in the economy as well as in the social issue. Today, there are almost fifteen million formalized microentrepreneurs. This article seeks to understand the relationship between the benefits and guarantees of the microentrepreneur formalization program, which has motivated the adhesion not only of small entrepreneurs working informally, but also of many Brazilians who have been encouraged to start up a business face of the labor market crisis.
